We advise family lawyers on different types of settlement, from relatively straightforward cases to complex financial arrangements of high net worth marriages and registered civil partnerships.

Two key areas of support

Wealth management is made up of two distinct roles which, when combined, can help provide the best long-term outcome for your client:

  • A financial planner – supports the financial proceedings in areas such as disclosure, form E challenges, cash flow forecasting, pensions, personal protection, tax, allowances, benefits, retirement and passing the client’s estate on to loved ones.
  • An investment manager – typically builds a client’s investment portfolio after divorce. They assist with the implementation of pension sharing orders and help the client achieve their long-term goals through the ongoing management of their investments through targeting growth, income or both.

This combination of support offers solicitors absolute compliance with respect to the SRA Code of Conduct.

Helping you reach the preferred outcome for your clients

Our experience suggests that we add most value when we are involved as early as possible in the process. We assist with the often problematic stages of financial disclosure right through to negotiation and post-settlement implementation.

We believe the process involves four distinct phases and our team can work with you to engineer the best possible outcome for your clients:

Pre-instruction

  • Making the due diligence process easier – we understand the importance of conducting full due diligence when working with a third party and our goal is to ensure this process is as easy as possible for you.
  • Choose the way you work with us – you can decide to work with one of our Relationship managers or if you prefer choose to work directly with one of our financial planners.
  • Referrals - we can have a joint meeting with your clients or if you’d prefer we can meet with them separately to establish what advice is required. This can be decided on a case-by-case basis.

Financial Disclosure

  • Support – you in designing a questionnaire that exposes financial gaps and which helps to ensure that Form E is completed in the most accurate way.
  • Understand – where challenges should be made and what financial questions it may be appropriate to ask.
  • Provide – a valuation of investments such as stocks and shares and any other financial assets.
  • Establish – and clarify a client’s tax position and give advice on the most tax-efficient way to manage their assets.
  • Undertake – a cashflow forecasting exercise to help support a client’s capital and income requirements over the long term.

Negotiation and financial remedy

At this stage our main role is to support the client’s understanding of their future financial security. We will use everyday language to explain complex financial matters such as:

  • Properties and finance – explain all the considerations needed to be made in the house-buying process.
  • Cashflow planning – this is a very effective way of building a broad understanding of what a client’s finances may look like following a financial settlement.
  • Pensions – as appropriate we can provide tailored advice on all matters regarding pensions to ensure your client makes the right decisions.
  • Protection – assist your clients with any questions relating to this important area of financial planning.
  • Tax – establish the tax position of the client and advise on the best investment structure.

Post-Settlement

  • Cash management – following a settlement from divorce proceedings, this is a sensible starting point ensuring the client is in the best possible position to begin with.
  • Implementation – of a pension sharing order can be complex and we can help smooth the process for the establishment of the new pension arrangement.
  • Build – a portfolio of investments based on the client’s personal circumstances.
  • Provide – ongoing advice and management of the client’s current and future tax position.
